Immigration and Customs Enforcement (ICE) agents have 75,000 signatures on a petition to protest the Obama administration’s policy of “prosecutorial discretion,” meaning if you are in the U.S. illegally, you can stay if you meet Obama’s “Presidential Priority” requirements, ad further meaning you will be released back into the population of citizens. Agents who attempt to deport the President’s personal “priorities” are threatened with job suspensions, loss of job, loss of benefits and job demotions. The main stream media is silent on the ICE revolt – no one talking but Bloggers and Fox News.

This Administration’s ever-expanding policy of ‘prosecutorial discretion’ that allows certain illegal aliens to avoid deportation and even get work permits gives ICE agents the discretion to determine which illegal aliens meet the criteria originally outlined in your August 2011 memo. However, it appears that your policy of ‘prosecutorial discretion’ does not allow for any discretion whatsoever,†reads the petition.

Crane and ten ICE agents filed a lawsuit against Homeland Security Secretary Janet Napolitano, and ICE Director John Morton and Morton’s assistant in late August, saying that they are forced to violate their oath, required to be an ICE agent, to protect and defend the Constitution of the United States. From the lawsuit filed, specifically citing the “prosecutorial discretion” policy, the agents claim:
“This Directive not only circumvents Congress, it also infringes on the plaintiffs’ ability to fulfill the oath they made to uphold the laws of this country.
Circumventing Congress should be a very big deal, and I predict it will be when Republicans control the U.S. Senate. God bless these agents who are serving our Nation by doing one of the most important and most dangerous jobs in Government.
